. NEW Map of Bushfire Prone areas 2017**

Please note map has changed **1st June 2017. I have checked on my past jobs, none have changed status.
Following the explanation offered up by Department of Planning.

The latest version of the Map of Bush Fire Prone Areas has now been released. The updated Map shows both ‘new’ bushfire prone areas and those ‘continuing’ from the previous edition of the Map released in May 2016. The newly designated areas are identified on the Map by a blue cross-hatched overlay.

The following applies from 1 June 2017 –

Areas which are no longer designated bushfire prone (will no longer be shown on the map)

  • Requirement for a BAL assessment for habitable dwellings from the deemed provisions Planning and Development (Local Planning Schemes) Regulations 2015 no longer apply (including applications lodged prior to but not determined prior to 1 June 2016).
  • Requirements of SPP 3.7 (applications be accompanied by BAL assessment and Bushfire Management Plan) no longer applies when assessing a development application, local structure plan or other planning proposal (including proposals lodged prior to, but not determined prior to 1 June 2016).

Areas which were already and continue to be designated bushfire prone (no change – identifiable by pink layer)

  • Planning and Development (Local Planning Schemes) Regulations 2015 requirements continue. Requirement for a BAL assessment for proposals that involve a habitable dwelling (except for a single house or ancillary dwelling on a lot/s less than 1,100m2) remains.
  • Requirements of SPP 3.7 should continue to be applied. Development applications, local structure plans and other planning proposals that are assessed on or after 1 June 2017 and are in a designated bushfire prone area should continue to be assessed against SPP 3.7.

Areas that with the new revision of the Map are now designated bushfire prone (identifiable by pink layer with blue cross-hatched overlay)

  • Planning and Development (Local Planning Schemes) Regulations 2015 requirements are delayed until 1 October (4 month transition period). Requirement for a BAL assessment for Development Applications that involve a habitable dwelling (except for a single house or ancillary dwelling on a lot/s less than 1,100m2) will come into effect from 1 October 2017.
  • SPP 3.7 no transition period applies. Development applications (except for a single house or ancillary dwelling on a lot/s less than 1,100m2), local structure plans and other planning proposals that are assessed on or after 1 June 2017 and are in a designated bushfire prone area should be assessed against SPP 3.7.

 

Please be aware that this Map release is also accompanied by an update to the Mapping Standard for Bush Fire Prone Areas. The wording of the Standard will be revised to state that designated bush fire prone areas are those shown in ‘pink’ on the Map and do not include the ‘non-pink’ areas within a property boundary.

 

As such a building located entirely outside of a bush fire prone area (i.e. located in a non-pink area), regardless of whether any other portion of the same lot is within a bush fire prone area:

  • does not require a further assessment of bush fire risk (such as a bushfire attack level (BAL) assessment); and
  • is not required to comply with the bush fire construction requirements of the BCA.
